The Modernization of Cosmetics Regulation Act of 2022 (MoCRA) is the biggest regulatory shake-up in the US cosmetics industry to date.

What Is The Purpose Of MoCRA? 

The Modernization of Cosmetics Regulation Act of 2022 falls under Subtitle E in the Consolidated Appropriations Act, 2023, which is available to read in full here. The Act was approved by Congress in 2022, however the exact requirements are still subject to change as of Q1 2024.

The Act is primarily concerned with enhancing safety provisions, improving product traceability, and bringing the US cosmetics industry closer in line with cosmetics regulations across the globe. 

The legislation is partially based on the ISO 22716 - an international standard for Good Manufacturing Practices (GMP) developed by the International Organization For Standardization. This ISO standard outlines a universal management system for the proper production, storage, and shipment of cosmetics. 



What Does The Act Require Of The Manufacturer? 

The Act places new legal requirements on ‘Responsible Persons’, which the FDA defines as “the manufacturer, packer, or distributor of a cosmetic product whose name appears on the label of such cosmetic product.” As outlined by The Society of Chemical Manufacturers and Affiliates (SOCMA), these responsibilities include (but are not limited to):

  • Adhering to the FDA’s full ‘Good Manufacturing Practices’ (GMP) for cosmetics. The draft guidance was provided in 2013 (with provisions similar to the ISO 22716 standards), and we can expect the FDA to release its full guidelines before the end of 2024

  • Mandatory manufacturing and processing facilities registration with the FDA 

  • Registering each cosmetic product with the FDA every year 

  • Maintaining records (including tests and studies) that show with reasonable certainty that a cosmetic product is safe for use

  • Notifying the FDA of any reports of serious adverse events 

  • Updating labels to include contact information for reporting serious adverse events and to include fragrance allergen information 


Due to these requirements, in most cases, it is no longer feasible for successful brands to produce cosmetics at home. However, there are some exemptions for smaller businesses. 



Is My Business Exempt From Some Of These Requirements? 

As explained by The Society of Chemical Manufacturers and Affiliates, brands with average gross sales (in the US) over the previous 3 years of less than $1 million are not legally required to follow the Good Manufacturing Practices (GMP), facility registration, and product listing requirements outlined in the Act. 

However, the FDA explains that this sales revenue exemption does not apply in all cases.

For example, there is no exemption for cosmetics that regularly come into contact with the mucus membrane of the eye with normal use. According to Glossy, the FDA currently claim that this includes mascara, eyeshadow, liquid eyeliner, eye makeup remover, and false eyelash adhesive. As noted in a 2022 study, many common eye makeup products trigger adverse effects on the ocular surface of the eye, including the conjunctiva. 

Products that are injected, intended for internal use, and those that alter appearance for more than 24 hours (for example hair dye) are also not exempt.

Additionally, there is no exemption at all for small brands when it comes to maintaining records and reporting serious adverse events.

MoCRA means it’s no longer feasible for successful small beauty brands (defined as earning over $1 million in average gross US sales over the previous 3 years) to make their products at home.
